Frequently Asked Questions
Can you fix a Form 8823 after it has been filed?
Yes. Even if the form is filed, the goal is to get the IRS to mark the finding as “Corrected.” Once we prove the issue is fixed, the recapture risk usually disappears (depending on the severity of the violation).
Do we have to fire our current management company?
Not necessarily. Many owners hire HAPI strictly as a “Compliance Consultant” to fix the specific audit mess, while keeping their current staff for day-to-day operations. However, if the issue is systemic, we recommend transitioning to our full Property Management service.
How much does a "Rescue" cost?
It depends on the number of units and the severity of the mess. We typically charge a “Per File” audit fee or a flat “Project Consulting” fee. Compared to the cost of losing your tax credits, our fee is a fraction of the investment.
What if the tenant has moved out?
This is the hardest scenario. If a non-compliant tenant has left, we cannot get their signature. In these cases, we work to build a “Memo to File” using whatever third-party data we can find to substantiate their eligibility to the best of our ability.
Do you handle HUD "REAC" / "NSPIRE" failures?
Yes. If you received a score below 60 on a REAC/NSPIRE inspection, you are in the “Troubled” category. We can manage the appeal process and the physical repairs needed to pass the re-inspection.
